HOW AND WHEN WILL THE LEVEL OF COMPULSORY PURCHASE COMPENSATION BE COMMUNICATED?

The first stage of the compulsory purchase process involves communication in accordance with art. 17 of Presidential Decree 327/2001.
The communication provided for in art. 17 of Presidential Decree 327/2001 notifies effectiveness of the declaration of public interest and gives owners whose properties are to be purchased the option of providing any details useful in determining the level of compensation. Based on the information provided by the acquirer and specific surveys conducted by the acquiring authority’s experts, this will be followed by the procedure for reaching agreement on the compensation to be paid.
In the case of land alone, if no agreement on compensation is reached, the urgent occupation procedure provided for in art. 22-bis may be activated, following prior payment of provisional compensation by the acquiring authority. In general, in the absence of an agreement, the acquirer may request the intervention of an arbitration panel of experts to set the level of compensation. Both the acquirer and the acquiring authority may in any event, after the arbitration panel has set the level of compensation, request a court assessment to reach a final valuation.
